I’m not a lawyer, and I’m not going to read the whole 100+ page ruling (PDF), but it sure looks to me like the argument is: “In order to decide if the Ten Commandments are an ‘establishment of religion,’ we have to
make upimagine the moral reasoning of a bunch of dead slavers.”The opinion is long because you can’t do all those gymnastics in a broom closet.
