New York, Pennsylvania, Federal charges are all separate by the sounds of it.
Mangione’s Pennsylvania lawyer Thomas Dickey was preparing to blame the Commonwealth of Pennsylvania that he is stuck in New York and can’t appear in Pennsylvania court. Delays of bringing his client to the courtroom, which if it doesn’t begin within 365 days for reasons caused by the Commonwealth’s failure to exercise due diligence, is grounds for filing for dismissal of the Pennsylvania charges he was initially arrested on, according to his lawyer’s memos.
(ETA: His lawyer has other strategies too, obviously. Many related to the constitutionality of his arrest at the McDonald’s)

I suspect this is just an excuse to charge him with anything in case if the murder charges fall through. They want to aggressively pursue anything against Luigi.
I don’t think the murder charges are going to fall through. He was at the location, he was caught fleeing the location with the illegal firearm which he designed and built at home and $10,000 cash in his backpack. He has an online history of promoting violence against CEOs. The murder charges are concrete.
Technically he was caught with a bag which then broke chain of custody and was subsiquently found to contain those items. Which leaves just being there and being edgey on the internet as evidence that wouldn’t be immediately thrown out in any normal trial.
If you say online that you should kill somebody and you do it thats going to be evidence at your trial.
